Distance Sales Agreement
This Distance Sales Agreement (“Agreement”) is made in accordance with the Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts. By placing an order through our website, you (“Buyer”) agree to the terms and conditions outlined below.

2. BUYER INFORMATION
The buyer is the individual who places an order through www.kinkybeadsatelier.com.
Details such as name, address, phone number, and email are those submitted during checkout and are considered an integral part of this agreement.
3. SUBJECT OF THE AGREEMENT
This Agreement concerns the sale and delivery of the products ordered by the Buyer through www.kinkybeadsatelier.com, with product types, quantities, prices, and delivery information outlined in the order confirmation.
4. DELIVERY OF PRODUCTS
Products will be delivered to the shipping address provided by the Buyer.
Delivery timelines vary depending on the type of product.
Ready-to-ship items: Dispatched within 3–5 business days.
Made-to-order/custom items: Dispatched within 5–10 business days or as stated in the product description.
Shipping is carried out via third-party courier companies.
If the Buyer is not available at the delivery address, the courier company may leave the parcel at a local branch for pickup.
5. PAYMENT TERMS
The Buyer may pay via credit/debit card, PayPal, or other secure payment methods offered on the website.
The order is considered confirmed only once the full payment is received.
6. RIGHT OF WITHDRAWAL (CANCELLATION)
Please note: Many of our products are custom-made, especially body-fitted leather harnesses and personalized art.
According to Article 15 of the Turkish Distance Contracts Regulation:
“The right of withdrawal shall not apply to contracts for goods made to the consumer’s specifications or clearly personalized.”
This means:
Custom-made and personalized items are non-refundable and cannot be cancelled once production begins.
For non-custom, ready-made products: The Buyer has the right to cancel the purchase within 14 days of receiving the product, without providing a reason.
To use the right of withdrawal:
The product must be unused and returned in its original packaging.
The return shipping cost is the responsibility of the Buyer unless the item is defective or incorrect.
7. RETURNS
Returns are accepted only for non-customized, ready-made products and only if they are unused, undamaged, and returned within 14 days of delivery.
Custom-made products (like body-sized leather harnesses or personalized artwork) are non-returnable under consumer law.
If the item is damaged or incorrect, the Buyer must notify the Seller within 48 hours of delivery, including photos and a brief description.
8. DELIVERY DELAYS
If the Seller is unable to dispatch the product within the expected timeline due to unforeseen circumstances, the Buyer may cancel the order. In such cases, any payment made will be refunded within 14 days.
9. PERSONAL DATA & PRIVACY
The Buyer’s personal data will be collected and processed in accordance with GDPR and KVKK (Turkish Data Protection Law No. 6698).

10. DISPUTE RESOLUTION
In the event of a dispute, the Buyer may apply to the Consumer Arbitration Committee or Consumer Court in their jurisdiction.
Applicable limits and authorities are determined by the Turkish Ministry of Trade.
11. ENFORCEMENT
This agreement is deemed to be accepted electronically when the Buyer completes their purchase and confirms the order. The terms herein become effective on the date the order is placed.
